Police Misconduct Cases We Handle

Police misconduct takes a lot of forms. If an officer, deputy or jail employee hurt you, arrested you without a reason or violated your rights, we want to hear about it. Some of the cases we handle:

  • Excessive force – beatings, chokeholds, unnecessary Taser use, or being slammed to the ground when you weren’t a threat.
  • False arrest and malicious prosecution – being arrested without probable cause, or charged with something the officer knew didn’t happen.
  • K-9 attacks – police dogs turned loose on people who weren’t fighting or running, including elderly people and people already on the ground.
  • Injuries in custody or transport – getting hurt in the back of a patrol car or police van, or inside a jail.
  • Jail medical neglect – being denied medication, medical care or help after an injury while being held.
  • Illegal searches – your home, car or phone searched without a warrant or a valid reason.
  • Sexual misconduct by an officer – any sexual contact, pressure or harassment from someone carrying a badge.

Who We Take On

We bring cases against city police departments, county sheriff’s offices, the Florida Highway Patrol, school resource officers and jail and corrections staff anywhere in Florida. Taking on a government agency doesn’t scare us. We’ve done it before, and we’ve won.

What To Do After Police Misconduct

  • Get medical care right away and keep every record and bill.
  • Take photos of your injuries right away, and keep taking them as they heal.
  • Write down everything you remember: the date, time, location, officer names, badge numbers and patrol car numbers.
  • Get the names and phone numbers of anyone who saw what happened.
  • Save any video you or a witness took. Ask us about requesting body cam and dash cam footage before it’s erased.
  • Don’t post about what happened on social media.
  • Don’t give a statement to the agency or its insurance company before you talk to a lawyer.

How Police Misconduct Cases Work

Most police misconduct cases can be brought as a federal civil rights claim, a claim under Florida law, or both. We look at what happened to you and figure out which path gives you the best shot.

Florida limits how much a person can collect from a government agency in a regular lawsuit. When the damages are bigger than that limit, the rest often has to be approved by the Florida Legislature through what’s called a claims bill. That’s exactly what we did for our client who was paralyzed after a ride in a police van. The Legislature passed his $2.3 million claims bill and Governor DeSantis signed it.

Deadlines in these cases can be short, and some claims require written notice to the agency before you can file. Don’t wait to call.

Frequently Asked Questions

Can I sue if my charges were dropped?

Often, yes. Dropped or dismissed charges can be an important part of a false arrest or malicious prosecution claim. And even if you were convicted, you may still have a claim for excessive force. Tell us what happened and we’ll tell you where you stand.

How much does it cost?

Every case is different. Many civil rights cases can’t be handled on a percentage (contingency fee) basis and require a cost deposit to get records, video and expert witnesses. We’ll go over costs with you up front during your consultation.

How long do I have?

Not long. Some claims require written notice to the government agency within a set amount of time, and evidence like video can be erased. Call us as soon as you can.

Do you only handle cases in Brevard County?

No. Our offices are in Titusville, Cocoa and Melbourne, but we handle police misconduct cases all over Florida.
